Eligibility

You must be at least 18 years old, or the age of majority where you live, to buy from the Site. We currently sell and ship to addresses in the United States only.

Products and cosmetic use

• Our products are cosmetics. They are not intended to diagnose, treat, cure or prevent any disease. The information on the Site is for general information only and is not medical advice.
• Results vary from person to person. Read the ingredient list before use, do a patch test, and stop using a product if irritation occurs. If you are pregnant or breastfeeding, have a skin condition, or have had a recent medical or cosmetic procedure (including a hair transplant), consult your physician before use.
• We try to describe and display our products as accurately as possible. Colors, packaging and images may vary slightly.

Prices, availability and errors

• All prices are in U.S. dollars. Prices and availability may change without notice.
• If a product is listed at an incorrect price or with incorrect information because of an error, we may refuse or cancel orders for that product. This applies even after an order confirmation has been sent. If your payment has already been charged, we will refund it.
• We may limit quantities per order or per customer.

Orders and payment

• Your order is an offer to buy. We accept it when we ship the product. We may refuse or cancel any order, for example because of suspected fraud, an error, or a product being unavailable.
• Payment is due when you place your order and is processed by our third-party payment processors. You confirm that you are authorized to use the payment method you provide.
• Sales tax is charged where required by law.

Shipping

We ship within the United States with UPS Ground. Standard shipping is free on orders of $75 or more with code FREESHIP75. Orders under $75 have a flat shipping rate of $9.95. Processing and delivery times are estimates and not guaranteed. Risk of loss passes to you when the carrier delivers the package. Full details are in our Shipping Policy.

Returns and refunds

All sales are final. Our Returns & Refunds Policy explains what to do if an item arrives damaged, defective or incorrect, or if a package is lost, and how to cancel an order before it ships. Promotions and discount codes

• Welcome offer: new email subscribers receive a one-time 10% discount code for their first order. The code is limited to one per customer and email address. It is not valid on bundles, cannot be combined with other offers and has no cash value.
• Bundles and other promotions are valid only for the period stated and while supplies last.
• We may change or end any promotion at any time, and cancel orders that misuse codes (for example, multiple accounts or code resale).

Intellectual property

All content on the Site is owned by us, by Cosmico Cosmetics or by our licensors and is protected by intellectual property laws. This includes text, images, logos, product names and design. You may not copy, reproduce or use it without our written permission. You may view and print pages for personal, non-commercial use.

Reviews and user content

If you submit reviews, comments or other content, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce and display it in connection with our business. You confirm that your content is truthful, based on your own experience, and not unlawful or offensive. We may remove any content at our discretion.

Prohibited use

You agree not to:

• use the Site for any unlawful purpose;
• interfere with its security or operation;
• use bots or scrapers;
• resell our products for commercial purposes without our authorization;
• provide false information.

Disclaimer of warranties

To the fullest extent permitted by law, the Site and its content are provided "as is" and "as available." Except as expressly stated in these Terms, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. This does not affect any rights you have that cannot be waived under applicable law.

Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Site or our products. Our total liability for any claim will not exceed the amount you paid for the product that gave rise to the claim.

Indemnification

You agree to indemnify and hold us harmless from any claims, losses or expenses, including reasonable attorneys' fees, arising from your breach of these Terms or your misuse of the Site.

Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Miami-Dade County, Florida, and you consent to their jurisdiction. Before filing any claim, please contact us at cosmicousa@gmail.com so we can try to resolve the issue informally.

Changes to these Terms

We may update these Terms from time to time. Changes take effect when posted on the Site. The version in effect when you place an order applies to that order.

General

If any part of these Terms is found unenforceable, the rest stays in effect. If we do not enforce a provision, we have not waived it. These Terms, together with our Privacy Policy, are the entire agreement between you and us about the Site.
